PUBLIC HEARING MINUTES

SEPTEMBER 5, 2006
7:30 P.M.

SOUTH WINDSOR COUNCIL CHAMBERS


PURPOSE:  TO RECEIVE CITIZEN INPUT ON AN APPLICATION RECEIVED FROM RESIDENTS AT CORNER-STONE DRIVE TO MODIFY THE MAINTENANCE PRACTICE ON A PORTION OF OPEN SPACE NEAR CORNERSTONE DRIVE IN ACCORDANCE WITH THE REQUIREMENTS OF TOWN ORDINANCE #136, A SUBDIVISION OPEN SPACE USE AND MAINTENANCE ORDINANCE.

The Public Hearing was called to order at 7:30 p.m. by Mayor Matthew Streeter.  The Assistant to the Clerk of the Council read the Call of the Meeting (a copy of which is attached).  The following Town Council members were present:  Mayor Matthew Streeter, Deputy Mayor Thomas Delnicki, and Councillors Fine, Havens, McCann, Moriarty, Pelkey, Prague, and Yagaloff.  Town Manager Matthew B. Galligan was also present.  There were approximately 110 people in the audience.

Mr. Michael Gantick, Director of Public Works explained that this is the first times that they have ever had an application come before the Town Council regarding modification or expansion of use of Town-Owned Subdivision Open Space, which is one of the things that is outlined in Ordinance #136 of the Town Ordinances.  This Ordinance gives any person in Town the right to submit to the Town Council a request to change how a property is maintained or used.  In doing so, there is a process that has been outlined about 10 years ago.  They submit an application and it goes through a process by being reviewed by the Open Space Task Force and ultimately coming to the Council for a Public Hearing where input is provided.  Ultimately, the Council has the authority to determine whether the application is accepted, rejected, or modified in any such way.  

Mr. Gantick explained that the Open Space Task Force does have some suggestions, but they will wait until the applicants have had a chance to present their application to the Council and the Public.  

John Legear of 55 Cornerstone Drive came forward and explained that they are asking for permission to maintain the Town-owned land that is the entrance to their neighborhood, at their expense.  He then gave a presentation explaining this further.

Mr. Gantick read a letter from Open Space Task Force into the record.  A copy of which is attached as Exhibit A.

There being no further discussion, Mayor Streeter called for a Straw Vote of the audience, the results of which were as follows:

Those not in favor of the modification to the maintenance practice on a portion of Open Space near Cornerstone Drive – 4
